With the caveat that if the Phils (or anybody) signed him to a minor league contract prior to the Winter Meetings, and didn't put him on their 40-man roster, he would be eligible to be drafted. If he doesn't sign a contract prior to the Winter Meetings, you're right; the Rule 5 is moot.

I recall that a number of years ago, the Phillies signed a catcher that had some experience and might compete for a backup catcher job, to a minor league contract before the winter meetings and then lost him in the rule 5 draft. Don't recall his name off the top of my head.
